By carrying out an “Online Transaction,” Purchaser is considered to have read and approved, and therefore, bound to the Terms and Conditions as described hereunder:

1. “Online Transaction” means the sale and purchase of any product(s) through the website https://balihaicruises.com, executed between the Purchaser and the relevant entity within The Bali Hai Group (“Contracting Entity”).PT. Bali Cruises Nusantara, Bali Hai Pty Ltd (Australia), and their respective affiliates are hereinafter referred to as The Bali Hai Group. The website https://balihaicruises.com is operated by The Bali Hai Group.Upon confirmation of an order, a contract of sale shall be executed between the Purchaser and the Contracting Entity identified at the time of booking and checkout. The applicable Contracting Entity shall be clearly stated in the booking confirmation and/or invoice.

   Each Contracting Entity operates as an independent contracting party and is responsible for the products and services it provides.

2. Each person/entity intending to purchase a product under the Terms and Conditions and the Online Transaction Procedures through the website https://balihaicruises.com are hereinafter referred to as the “PURCHASER.”
3. The Purchaser hereby states to have been 18 years old and approves the Terms and Conditions, or for any purchaser under 18 years old is deemed to have obtained their parent’s/guardian’s approval and such approval is awarded consciously without any pressures or coercion, and the purchaser is able to act as a legal subject to conclude an agreement according to either the prevailing rules and regulations of Australia or Indonesia.
4. The Online Transaction Object is the sale and purchase of “Cruise, Accommodation and Leisure Product(s)” where the transaction time and premises shall be determined by The Bali Hai Group and such product may be used according to the relevant product, class, price and time (if there are options) chosen by Purchaser.
5. Payment details are collected and processed via secure systems operated by The Bali Hai Group on behalf of the Contracting Entity. Payments are processed through authorized payment gateways (Adyen) in a PCI-compliant environment.
   • The currency charged shall correspond to the Contracting Entity handling the transaction.
   • All transactions conducted with PT. Bali Cruises Nusantara within the territory of the Republic of Indonesia shall be denominated and settled in Indonesian Rupiah (IDR) in accordance with Bank Indonesia regulations.
   • Any display of foreign currency for such transactions in the Indonesia territory is for reference purposes only.

   The Contracting Entity responsible for the transaction will be clearly identified at checkout and in the booking confirmation. The Purchaser agrees that the applicable currency and Contracting Entity are determined at the time of checkout.

6. “Cruise, Accommodation or other Leisure Product” in this Online Transaction means a product organized by The Bali Hai Group. Meanwhile, the premises and time shall be according to the announcement made by Bali Hai Cruises Group and chosen by the Purchaser through the website https://balihaicruises.com
7. All Online Transactions Procedures on https://balihaicruises.com constitute an integral part of and inseparable from the Terms and Conditions, and therefore they bind Purchaser.
8. These Terms and Conditions shall constitute a Binding Agreement to the Purchaser.
9. The Contracting Entity is entitled to accept or decline a product purchase.
10. The Contracting Entity accepts booking amendments with minimum 24-hour notice. For group bookings (20 or more travelers) an extended notice period of one week applies.
11. The Contracting Entity is not responsible for any complaint/claim and refund, except as the Terms and Conditions stipulate otherwise.
12. The Contracting Entity may cancel an Online Transaction without refunding the product purchase price or without providing any other compensation if a product purchase price is not carried out based on the Terms and Conditions.
13. The Contracting Entity may take legal actions based on the civil code and/or criminal code against any party purchasing, owning and/or controlling a product illegally or contravening with the Terms and Conditions and the Online Transaction Procedures.
14. Each Online Transaction and these Terms and Conditions shall be governed by the laws applicable to the Contracting Entity identified at the time of booking.
15. Any dispute arising from the Online Transaction shall be settled amicably in reference to the Terms and Conditions. The Purchaser hereby states that they will not make any claim against The Contracting Entity whether under civil or criminal law.
16. The Contracting Entity is not responsible for any credit abuse in the Online Transaction and for any bank decline in relation to an Online Transaction.
17. If a product has to be cancelled by the Contracting Entity, the product is non-refundable except as expressly provided under these Terms and Conditions. Any applicable refund shall be processed in accordance with these Terms and Conditions and in the original transaction currency. The product price is the price advised at the time of booking, excluding administration fees or other applicable charges unless stated otherwise.
18. By carrying out an Online Transaction, Purchaser is bound to the conditions as follows:
    • One (1) product is valid for the passenger(s) confirmed prior to their departure.
    • Each guest is prohibited from bringing pets or animals of any kind aboard the cruise.
    • Each guest is prohibited from carrying weapons, guns, illegal drugs and psychotropic substances, alcoholic beverages and/or other hazardous substances or explosives and specific fruits with strong smell
    • The Contracting Entity is entitled to inspect and/or search each guest and/or their luggage for security purposes.
    • The Contracting Entity is not responsible for any damage and loss.
    • The Contracting Entity shall not be liable for any death, injury, loss or damage, to the extent permitted by applicable law.
    • The Contracting Entity is entitled without any refunding or whatsoever compensation to prohibit any person to enter or ask any person to leave the product for security and safety purposes, if necessary.
    • The Contracting Entity is entitled to cancel the product without any refunding or whatsoever compensation if there is anything beyond its reasonable control, i.e. force majeure happening to cause a dangerous situation for guest safety.
19. The Contracting Entity reserves the right to operate an alternative vessel or alter cruise schedules depending on guest numbers or financial viability

Force Majeure (FM)

• The Contracting Entity shall incur no liability, to the extent permitted by applicable law, if performance of the contract is prevented or hindered, beyond its reasonable control and in particular and without prejudice to fire, flood, riots, accident, strike, volcanoes, earthquakes, tsunamis, pandemic or other acts of nature/act of God for any loss or damage incurred by the client.
• For bookings where guests cannot complete their stay and which meet the FM conditions, the guests can request one of the following:
  • Find new dates for a future booking (different rates may apply – the difference is paid by the guest).
  • Issue a voucher for a future stay, with the same value as the original price paid by the guest.

Cancellation

All cancellation requests must be submitted to [email protected] and will be handled by the relevant Contracting Entity. The products offered by the Bali Hai Cruises Group are dependent on weather conditions, and the Contracting Entity reserves the right to change the schedule for guest safety and comfort reasons

Bali Hai Cruises Products Cancellation Policy

1. For cruise and dive bookings, cancellations must be received in writing ([email protected]) with the email address used to make the booking and the name of the person who made the booking, along with the date of the product booking.
2. For cruise and dive bookings, cancellations received up to 48 hours of due cruise date will incur no cancellation fee.
3. For cruise and dive bookings, cancellations received within 48 hours of due cruise date will incur 100% of the total booking

Hai Tide Beach Resort Accommodation Cancellation Policy

1. For accommodation bookings, cancellations must be received in writing ([email protected]). Please supply the following details:
   • The Email Address used to make the booking
   • The Full Name of the person who made the booking
2. Cancellations made more than 30 days prior to the arrival date will incur a charge of 25% of the total booking.
3. Cancellations made 30 days or less prior to the arrival date will incur a charge of 50% of the total booking.
4. Cancellations made 14 days or less prior to the arrival date, or in the case of a No Show, will incur a charge of 100% of the total booking.
5. No refund will be given for early check-out.
6. We recommend that you take out travel insurance at the time of any booking.

Wedding Package Cancellation Policy

1. If we do not receive your deposit by the due date, your booking will be released.
2. Due to the administration work provided by Bali Hai Cruises and as we do not overbook our services, it is understood that any deposit amount received is non-refundable or transferrable and used to offset accrued costs.
3. Cancellation of a booking within 30 days prior to the wedding is chargeable in full.
